Dataaxy Terms of Service

These Terms of Service ("Terms") govern access to dataaxy.com and the services provided by Dataaxy S.A.S ("Dataaxy", "we", "us", or "our"). By accessing or using Dataaxy, you agree to these Terms. If you use Dataaxy for an organisation, you confirm that you have authority to bind that organisation.

1. Eligibility and accounts

You must be legally capable of entering into these Terms and may use Dataaxy only in compliance with applicable law. You must provide accurate information, keep your sign-in links and account access secure, and promptly update information that becomes inaccurate. You are responsible for activity carried out through your account unless you notify us of unauthorised access without undue delay.

You may sign in through an email magic link or an available third-party sign-in provider. Your use of that provider is also subject to its own terms.

2. The Dataaxy service

Dataaxy is a specialised job board and talent discovery service. It lets recruiters and companies publish and manage jobs, receive or route applications, view recruitment analytics, and discover public talent profiles. It lets talents create a profile, browse and save jobs, receive alerts, and apply for participating jobs. Some listings route applicants to an external website or email address.

Candidate access and basic recruiter job posting are currently free. We may add, remove, or change features as the service evolves. If a change materially affects a paid purchase already made, we will continue to provide the purchased benefit or offer an appropriate remedy as required by law.

3. Recruiter and job-listing obligations

If you publish or manage a job, you confirm that you are authorised to act for the relevant organisation and that the listing is genuine, current, lawful, and not misleading. You are responsible for the job description, application destination, screening questions, hiring decisions, communications with candidates, and compliance with employment, equality, advertising, privacy, and record-retention laws.

You must not publish discriminatory, fraudulent, unsafe, illegal, expired, duplicated, or unrelated listings. Dataaxy may edit formatting, decline, archive, or remove a listing that violates these Terms, creates risk for users, or does not meet our quality standards.

4. Talent profiles and applications

You are responsible for the accuracy of your profile, resume, application answers, and other information you submit. A public talent profile is visible on the web. An unlisted profile remains accessible through its direct URL even though it is excluded from Dataaxy directories and our sitemap. Do not publish information you do not want others to see.

Submitting an application authorises Dataaxy to store it, make it available to the responsible recruiter or company, and send related notifications. The recruiter or company controls its own recruitment process. Dataaxy does not guarantee that a listing is suitable, that an employer will respond, that an interview or offer will result, or that third-party statements are accurate.

5. Acceptable use

You must not:

• break the law, infringe another person’s rights, impersonate someone, misrepresent an affiliation, or use Dataaxy for fraud, harassment, discrimination, or spam;
• upload malware, probe or bypass security, disrupt the service, abuse rate limits, or access accounts or data without authorisation;
• scrape, harvest, resell, or systematically extract profiles, applications, contact details, or job data except with our written permission or as clearly allowed by applicable law;
• use personal data obtained through Dataaxy for a purpose unrelated to legitimate recruitment or in violation of our Privacy Policy or applicable data-protection law; or
• interfere with another user’s use of Dataaxy or attempt to reverse engineer a non-public part of the service except where that restriction is prohibited by law.

6. Your content and our content

You keep ownership of content you submit. You grant Dataaxy a worldwide, non-exclusive, royalty-free licence to host, copy, format, display, distribute, and otherwise process that content only as needed to operate, secure, promote, and improve the service. This licence ends when the content is deleted from active systems, except for lawful retention, backups, content already shared with a recruiter, and rights needed to resolve a dispute.

You confirm that you have the rights and permissions needed to submit the content. Dataaxy and its licensors own the service, brand, software, design, and content we provide. These Terms do not transfer any Dataaxy intellectual-property rights to you.

7. Founding Featured Job and payments

The current paid service is a one-time purchase called the Founding Featured Job. It costs $49 USD and gives an eligible active job featured placement for 30 days after activation. It is not a recurring subscription and does not renew automatically. The checkout page confirms the price and benefit before you pay.

Stripe processes checkout and card details. Dataaxy does not store complete card numbers. You authorise Stripe and Dataaxy to charge the amount shown at checkout, plus any applicable tax. Your bank may apply exchange or card fees when paying from a non-USD account.

If a boost cannot be delivered because of a Dataaxy error, contact us so we can restore the benefit or provide another remedy. Refunds and statutory withdrawal rights are handled according to applicable law and any additional terms shown at checkout. Archiving or deleting a boosted job at your request does not extend the boost period unless required by law.

8. Third-party services and job sources

Dataaxy may link to employer sites, applicant-tracking systems, social networks, payment services, or other third parties. Their services and content are governed by their own terms and privacy policies. We are not responsible for a third-party service, but nothing in these Terms limits rights you may have against Dataaxy under mandatory law.

Some job information is collected from public or licensed sources and may be reformatted or classified for discovery. Rights holders can contact us about inaccurate, expired, or unauthorised content.

9. Suspension, removal, and account deletion

We may suspend access, restrict features, or remove content when reasonably necessary to protect users or the service, investigate suspected misuse, comply with law, address non-payment, or enforce these Terms. Where appropriate, we will provide notice and an opportunity to correct the issue.

You may stop using Dataaxy at any time. Signed-in users can select "Delete account" in account settings. Deletion removes the active database account and queues removal of personal account files from Dataaxy’s upload storage. Deleting a recruiter account archives and detaches its jobs and may detach its companies; company assets retained with those records, such as a company logo, may remain published. Information already provided to another party, payment and accounting records, security records, and backups may remain where described in our Privacy Policy or required by law.

10. Disclaimers

Dataaxy provides a platform for discovery and communication; it is not an employer, recruitment agency, or party to an employment agreement between users. To the extent permitted by law, the service is provided "as is" and "as available". We do not promise uninterrupted operation, a particular ranking or traffic level, the continued availability of any listing or profile, or any recruitment outcome.

11. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including applicable consumer rights. To the extent permitted by law, Dataaxy is not liable for indirect or consequential loss, loss of opportunity, loss of profit, or loss caused by third-party content, hiring decisions, external sites, or unauthorised use outside our reasonable control.

For a paid service, and to the extent permitted by law, Dataaxy’s aggregate liability arising from that paid service will not exceed the amount you paid for it during the twelve months before the event giving rise to the claim. This limit does not apply where mandatory law requires a different remedy.

12. Governing law and disputes

These Terms are governed by French law. The competent French courts have jurisdiction, subject to mandatory rules that allow a consumer to bring a claim in another court or rely on protections of the country where they live. Before starting formal proceedings, please contact us so we can try to resolve the dispute.

13. Changes to these Terms

We may update these Terms to reflect changes to Dataaxy or the law. We will publish the revised Terms here, change the effective date, and provide additional notice when legally required. Changes do not retroactively reduce a paid benefit already purchased. If you do not agree to revised Terms, you must stop using Dataaxy.

14. General terms

These Terms and the Privacy Policy form the agreement between you and Dataaxy about the service unless additional written terms apply. If one provision is unenforceable, the remaining provisions continue in effect. A delay in enforcing a provision is not a waiver. You may not transfer these Terms without our consent; Dataaxy may transfer them as part of a merger, reorganisation, or sale, subject to applicable law.
